DO I NEED A LAWYER TO FILE A BANKRUPTCY?
This is a very important question for debtors.
Under NYS law only a licensed attorney is allowed to give legal advice.
Bankruptcy petition prepares and paralegals can ONLY help you fill out paper work. Bankruptcy Petition preparers and paralegals are forbidden from offering you any legal advice whatsoever.
Additionally, a Bankruptcy Petition Preparer and/or Paralegal CANNOT represent you at the mandatory Section 341 Meeting, only an admitted attorney can.
That means that you would need to go to the Bankruptcy Court alone, to attend the Section 341 Meeting if you were to file without an attorney. Attending the meeting without legal representation would put you at a disadvantage if the Bankrtupcy Trustee were to challenge the exemptions listed in your petition.
Also, an improperly filed Bankruptcy case can subject a debtor to the dismissal of his/her Bankruptcy case as well as subject the debtor to losing non-exempt assets and possible exempt assets. It is important to have knowledgeable representation in order to receive the maximum amount of exemptions allowable under the Bankruptcy Code.
It is important to note, that there are strict deadlines as to what, when and how a document need to be filed with the Bankruptcy court. Failure to timely file documents and/or improperly filed and missing information can result in the dismissal of your case.
